Dear Sir,
Please take notice that I have the instructions from my clients mentioned above to write you as follows:
- That the Unilever Bangladesh Limited and the Channel i Television are jointly organizing a nationwide beauty contest, named as Lux Super Star, using the slogan ‘দেখিয়ে দাও অদেখা তোমায় ‘ [REVEAL THE UNSEEN YOU]. The organizers are making huge campaign for this event in electronic and print media as well as in social media. A thirty second TVC is frequently being telecasted in all the major television channels of Bangladesh.
- That the arrangement of the so-called beauty contest, its slogan being ‘দেখিয়ে দাও অদেখা তোমায় ‘, its advertisement contents and the TVC all are indecent, immoral, and also violation of law of the land.
- That the article 39 (2) of the Constitution of Bangladesh provides freedom of expression subject to the conditions of, inter alia, decency and morality. Thus an indecent or immoral beauty contest is outside the realm of constitutionally protected freedom of expression. Section 2 (b) of the Indecent Advertisements Prohibition Act, 1963 provides that “indecent” includes whatsoever may amount to any incentive to sensuality and excitement of impure thoughts in the mind of an ordinary man of normal temperament, and has the tendency to deprave and corrupt those whose minds are open to such immoral influence, and which is deemed to be detrimental to public morals and calculated to produce pernicious effect, in depraving and debauching the minds of persons. The so-called beauty/acting contest, named as the Lux Super Star and its advertisements are incentive to sensuality and excitement of impure thoughts in the minds.
- That the Indecent Advertisements Prohibition Act, 1963 prohibits and penalizes indecent advertisements in Bangladesh.
- That the state religion of Bangladesh is Islam, as laid down in the Article 2A of the Constitution of Bangladesh, and thus the creed of Islam is officially endorsed by the state. The creed of Islam completely rejects this sort of beauty/acting contest. Allah Subhanahu wa Ta’ala declares in the Quran Majeed: “And tell the believing women to lower their gaze and guard their chastity, and not to reveal their adornments except what normally appears. Let them draw their veils over their chests, and not reveal their ˹hidden˺ adornments except to their husbands, their fathers, their fathers-in-law, their sons, their stepsons, their brothers, their brothers’ sons or sisters’ sons, their fellow women, those ˹bondwomen˺ in their possession, male attendants with no desire, or children who are still unaware of women’s nakedness. Let them not stomp their feet, drawing attention to their hidden adornments. Turn to Allah in repentance all together, O believers, so that you may be successful.” [ Surah Noor (24), Ayah 31]
- That the indecent contest asks the women to expose herself as ‘দেখিয়ে দাও অদেখা তোমায় ‘ [REVEAL THE UNSEEN YOU], while Allah Subhanahu Ta’ala decreed to women: “And stay in your houses, and do not display yourselves like that of the times of ignorance…” [Surah Ahzab (33), Ayah 33]. Thus the so-called contest violates the Islamic creed, which is also the official creed of Bangladesh.
- That my clients are law-abiding and peace-loving citizens of Bangladesh and. Their Constitutional and legal rights to live in a decent and moral social environment is hampered by the arrangement of such a vicious, indecent, immoral and filthy contest, named as the Lux Super Star 2018.
- That my clients gravely need you to:
- cancel the so-called contest, named as the Lux Super Star;
- stop all sort of campaign of that contest in the electronic and print media as well as in social media.
Under the circumstances, I request you to take the necessary steps within 4 (four) working days of receipt of this Legal Notice, failing which I have the instruction from my clients to take legal action in the Court of law.
A copy of this legal notice is kept in my office for future reference.
